Facts
- The gun show loophole is a lie perpetuated by the liars for the ignorant. Criminals do not get their guns from gun shows, and they certainly don't get them using this minor exploit.
- The sellers at gun shows are Federal Firearms Licensees (FFLs). By law, they're required to perform background checks on all sales, regardless of where the sale takes place (either at a gun show or at their brick and mortar store). If you don't know that, thank a dishonest leftist or their media for lying to you.
- The loophole is that in theory, two parties can meet at the show, and make a deal to go out to the parking lot and make a sale (trade). That's the same as the Internet loophole, craigslist loophole, or any bar, garage sale, or public place. "You wanna buy this gun?"... there's nothing unique about a gun show.
- Remember, in many states that want to close this loophole, it's already illegal to do these transfers. In some states, they leave it up to the gun shows or venues to regulate. And most make it against the rules -- though enforcement varies. But this is the same at a swap meet, estate sale, etc.
- Even there, if you're using the craigslist, bar, garage sale, or Mcdonald's loophole to buy a gun, if the seller believes the buyer is prohibited to buy or is on any kind of controlled substance, the sale is actually deemed illegal. So the imaginary "loophole" is that it is not a crime to sell or give a gun to someone else who has a legal right to have it, without the government involved?! That doesn't sound that bad to me.
- No mass shooter and few criminals have ever gotten a gun this way. Think about it, if you're a criminal, do you want to be going up to strangers and saying, "Hey, I want to buy that gun". It's easier for them to get it legally, straw purchase (illegally), or through more shady and thus less traceable characters. If the left had found someone that had used this to cause mayhem, they would have televised the crap out of it -- and they never have.
What the left really wants to do is use this imaged "loophole" to confuse the gullible into signing up for outlawing ALL private party transfers. To stop private party transfers means that it is a felony if your wife or son borrows your gun, or you gift it to them. You sell a gun to a neighbor/buddy, or trade for some good or service: you belong in prison.
Pretend you're smarter than all the gun controllers combined (which is a pretty low bar), you know that virtually NO CRIMINAL has ever been caught by tracing serial #'s on guns. You can't get the stats on this, because the Cops/FBI doesn't track it, because the numbers are so low, that nobody can name a criminal caught using that method. Remember, the criminals get their guns illegally, and they don't leave them behind at the scenes of crimes (they're worth $500+, why would they leave one?). So there's no value in all this tracing for catching criminals.
But there's high value in using that tracing to intimidate legal gun owners, accidentally leaking their names and making them targets (as NY and California has done a couple time), it would be handy to create a list of whose house to go to for gun confiscation, and so on. Which is why no gun owner would comply with these laws. You can turn lots of gun owners into criminals, but you can't make legal gun owners into slaves. Gun owners would file off serial numbers, and you'd create a burgeoning black market if the government tried to start tracking their guns. Then what? You're going to ruin people's lives for not believing that government should be able to violate your 1st, 3rd, 4th, 5th amendment rights to privacy -- all as a way to infringe on your 2nd amendment rights as well?
