NYT Lawsuit

The NYT kept repeating a lie that a Sarah Palin campaign ad incited the shooting of Gabby Giffords by a Democrat.

6 Years after the NYT admitted in their own paper that a Palin campaign ad targeting many cities was not responsible for Jared Lee Loughner shooting Gabby Giffords, they ran another Op Ed linking the two. Sarah sued for Libel as they refused to admit the repeated mnistake.

The shooter (Jared Lee Loughner) was not a conservative (as the paper had misreported), he was actually a left leaning loon (his favorite book was the Communist Manifesto, he hated Bush, loved John Kerry, was an atheist, and wasn't aware of the flyer)).

Democrats had run similar ads with targets against conservatives, Palin's was targeting a few cities (not even people), so was less inflamatory than most leftist rhetoric but double-standards apply. And Loughner admitted he wasn't aware of the flyer.

Loughner had met Gifford before, and he had never seen or was aware of the crosshair flyer, and his reasons were his delusions and conspiracies and he was reasoned to be mentally incompetent.

The Times had reluctantly published all that, eventually in their News sections, but continued to publish articles in their Editorial pages that trashed Palin (and made linkages between Palin and Loughner, that their News pages had admitted weren't there).

The Times "won" a lawsuit in 2017, then ran another editorial that repeated the lie again, and got a second lawsuit. But Obama appointed judges keep impossible standards for slandering conservatives.

The Judge (Jed Rakoff) not only threw out the case while the Jury was deliberating, he basically said that proving they lied didn't count, they needed to prove malice and not incompetence. But he said that while not having the Jury sequestered, so they all got to hear the Judge's opinion before the Jury got to decide - which makes for a mistrial.

A conservative is doomed in DC or NY courts. Period. There was never any chance they can win without an appeal.

It doesn't matter that the NYT had published articles admitting the story was false, and years later was still repeating the lie, and their defense was that it was just incompetence... but trust us there was no conspiracy going on to sabotage her, just because the left worked together and had the JournoList and other tools to conspire to attack their political enemies in unison. Nope, nothing to see here.

So the point is if you're a leftist newspaper in a leftist town, you can openly lie with malice, and just claim stupidity later because you didn't bother to fact check your own story, against your own newspaper. And your readership won't care, because they only lied to slander a conservative, and that's OK with them.
